I am wanting all your input to see if this would be a case of contempt of court or if I am just over reacting? According to our court papers, my ex and I are supposed to communicate via email. I have yet to receive his email address. We were communicating via text, but his cell phone has been turned off because he hasn't paid the bill. So, I cant get ahold of him or my kids without driving the 30 miles to his residence to communicate in person. Also, we are supposed to notify one another of doctor's appointments etc so both parents have the opportunity to be there. I schedule an appointment for my son, drive there to pick him up and I am told that he already has another appointment scheduled. My ex says he didn't know anything about my appointment, which is a lie because my ex said that he would make sure he would be at the appointment. My boyfriend can testify to that because he heard him say it. Anyway, I ask for the location of the other appointment and I am told it is none of my business as they drive off. I am getting my son checked for ADHD, which my ex MIL is opposed to. Today she slammed the door in my face and told me to never set foot on her property again. (My ex lives with his mom.) I know I can't do much about her, other than make arrangements to pick my kids up in a neutral area. But my question is can I charge him with contempt for refusing to provide adequate contact information and refusing to tell me where the doctors appointment will be so I could attend? My understanding is that if he goes against the divorce decree, that is a basis for contempt. Is that correct?

I don't want to get charged Lawyers cost money, but message boards don't. I'm hoping someone will be able to answer the question, so I know whether or not I need to call my attorney. Sorry if that is not allowed.

If the decree says you're supposed to communicate via email, and this whole time you've been texting instead, doesn't that make YOU in violation of the decree also? Seems like you or your lawyer should have jumped on this a long time ago.

Have your attorney file a motion to show cause...compel the ex to explain exactly why he's been violating the decree...

 

but be prepared to prove that you gave him your email address...

Thanks Pyran67. I have the text where I provided my email address, plus my attorney gave it to him directly.

Make sure that you communicate with him in writing as much as possible. If its just a he said she said, the judge will just ignore it.

Every time I read your posts I think, "This cannot be real". If my kids were involved I would be, I dunno, doing SOMETHING about it! But your post actually provided me with the perfect excuse for a status I put on facebook just a little bit ago that I don't feel like explaining. So I thank you for that, I guess. Every time I read your posts I think, "This cannot be real". If my kids were involved I would be, I dunno, doing SOMETHING about it! You guys do realize that this little snippet will probably get Thor killed, right? If not by OC, then by The Cat. I hear the Cat has been trying to take him out since he Ninja impregnated a certain Pucci loving, cheery eating fart machine. From what I understand, Ugby is Thor's only ally. So long as he keeps doing her bidding.
