I BEEN DISPUTING LATES PAYMENT WITH EQUIFAX AND ALWAYS VERIFIED , I GOT PROOF (LETTER FROM GMAC ) BUT THEY STILL PLAYING RUDE...SO NOW I FILL THE COMPLAINT...HOPE I DONT MAKE IT WORST

BBB worked very well for me with Equifax. I managed to get rid of a Dismissed Chapter 13 BK, in less than 30 days!

 

They will send you a form letter from Exquifax asking you to call a special number for dispute resolution. I DID NOT do this. Instead i sent the BBB the documents they requested and let them handle it. I was afraid i would become irate when talking to the CSR. the BBB did fine for me.

does the FTC actually do anything when you complain to them. I have not gotten that far yet. In your opinion then a complaint to the FTC rather than the BBB is a more powerfull tool against the CRA's?

The FTC will do absolutely nothing on a single, individual complaint. They accept complaints and if they see a pattern develop regarding a particular business, then they might get involved.

Would you care to shed some light on your Jedi powers of being able to use the BBB to remove a dismissed CH 13???

 

I've got BK13 from 1995 that EQ Refuses to remove...even though it lists liablities at $0 and No Creditors. It's an empty file. I never even paid the attorney a dime or showed up for court. I never even signed a BK petition-only a payment plan sheet. Found a way to pay my own debts. Nothing even remotely related to the BK13 is on my CR.

 

Can you give me the low-down on how to do this? I'd be really grateful!!!! :)

Look in the letter forum for a letter from me for disputing dismissed bk's.

Here is what I did. I filed chapter 13 in 10/1996 had it dismissed 11/1996, also found a way to pay all my bills then. Still on my report. I disputed with all CRA's as not mine, they all verified. So started doing some research. Go to the FAQ section of Experian and Trans Union websites and do a search for bankruptcy or Public records. Both Experian and TransUnion websites specifically state that they only report either DISMISSED or DISCHARGED CHAPTER 13 BK's for 7 years from date of filing. WHAM! at the seven year mark in the middle of disputes they were deleted by Experian and TransUnion. Thought Equifax would do the same, and boy was I wrong! I printed out the pages from Experian's website and TransUnion's website relating to their policy of reporting Chapter 13 BK and sent a letter to equifax requesting the same treatment. NO WAY! They verified again! So I called very irately and proceeded to talk to a CSR rep. She told me Equifax's policy is to report a DISCHARGED Chapter 13 for seven year, but they were allowed to report a DISMISSED chapter 13 for ten years. So she said sorry nothing she could do.

 

Then I filed a complaint with the BBB against Equifax alleging discrimination in their reporting methods. I refered to Experian and TransUnion policy, and said I was verbally informed that Equifax policy was to report a discharged CH 13 for 7 yrs and a dismissed ch 13 for 10 years. I simply said to the BBB that federal law allows them to report for 10 years and I agreed with that, but did not REQUIRE them to report this information. Therefore, in my view they were applying discriminatory factors when deciding what TYPES of chapter 13 to either report or not report. I simply asked the BBB to not let equifax engage in discrimination in reporting information on my credit file.

 

BBB sent my letter to Equifax, then BBB sent me a letter giving me a SPECIAL NUMBEr for equifax special resolutions to call since they could not access my file without my personal identifying information. They told me if I chose not to do this I would need to send the BBB a copy of my DL and SC card and they would handle from there. I chose not to call, because I felt i would get the typical run around. So I sent the BBB the copies they requested and WHAM gone in less than 30 days.

 

This worked for me, i cannot guarantee it will work for you. And I hope this helps. Let me know if you need further info.

Sassy: i honestly did not think they would call me on it! I truly believe this was in discrimination. A Chapter 13 is a Chapter 13 regardless of whether dismissed or discharged. Personally I just thought they did not want the BBB report to negatively reflect an unsatisfied report on their file is whey they caved in. BUT I AM SO GLAD it worked for me. Just dont know if it will work for anyone else.

 

However in regard to the BBB, it dont work so well with Experian. Trying to get a paid tax lien removed from Experian and TU. They are still showing "filed" I have documents showing paid. No Answer from EX and TU regarding the BBB complaint. I just think EX is more publicity conscious than the other too. But maybe i am wrong, as i am so new to working on this.

Well no, Marv, a discharged C13 is one that was completed via a court established payment plan.

 

A dismissed C13 means you didn't complete your payment plan and follow through to discharge, for whatever reason -- day 2 after filing or year 4.5.

 

Accurate and complete reporting requires the public record show as discharged or dismissed -- how can that be discriminatory?

 

I understand the differences there, it doesn't seem fair to those that filed and changed their minds -- so, never began a payment plan at all.

 

Either way, I'm glad it worked for you too, just surprised. Some people have been very successful with BBB complaints (INCH is coming to mind).

 

However in regard to the BBB, it dont work so well with Experian. Trying to get a paid tax lien removed from Experian and TU. They are still showing "filed" I have documents showing paid. hmmmmm, you may want to rethink your strategy there, as the reporting clock for tax liens is triggered by the PAYMENT date versus the filing date (that's right the government doesn't play fair or follow the rules when it comes to debts owed them -- they make their own rules instead, ditto for student loans and a recent thread about child support as well) -- should they accurately report the paid status, you'll be stuck with that longer than if you get it removed because it is inaccurate and can't be verified.
